Terms and Conditions

1. Definitions

Company means Accurate Inspections Limited.

Inspector means the person conducting the inspection on behalf of the Company.

Client means the person or entity engaging the Company to perform the inspection.

Property means the property identified in the inspection report.

Report means the written report prepared following the inspection.

2. Scope of Inspection

The inspection is a visual, non-invasive assessment of the readily accessible areas of the property at the time of the inspection.

The inspection is intended to identify significant defects, maintenance issues and observable building conditions that may affect the property’s value or safety.

The inspection is not a guarantee or warranty that the property is free from defects.

3. Inspection Standards

The inspection is carried out using reasonable skill and care and is based on accepted New Zealand building inspection practices.

The inspection is limited to conditions that are visible and accessible on the inspection date.

4. Areas Not Inspected

Unless specifically agreed in writing, the following are excluded from the inspection:

  • Concealed or inaccessible building elements
  • Underground services
  • Plumbing performance testing
  • Electrical testing
  • Gas installations
  • Heating and cooling system performance
  • Swimming pools and spa pools
  • Septic systems
  • Retaining wall engineering
  • Geotechnical issues
  • Land contamination
  • Methamphetamine contamination
  • Asbestos identification or testing
  • Pest infestation (unless obvious)
  • Boundary identification
  • Surveying matters
  • Compliance with building consents or code compliance certificates
  • Future performance of building materials

5. Access

The Client acknowledges that the Inspector can only inspect areas that are safely accessible.

Furniture, floor coverings, stored goods, locked rooms, wall linings, insulation, cladding systems and similar items will not be removed or dismantled.

6. Moisture and Weathertightness

The inspection includes a visual assessment for signs of moisture ingress where evidence is observable.

No destructive testing will be undertaken unless separately agreed.

The absence of visible moisture does not guarantee that concealed moisture or leaks are not present.

7. Report Limitations

The Report reflects the condition of the property only on the date of inspection.

Conditions may change after the inspection due to weather, occupancy, maintenance, or deterioration.

The Report should not be relied upon as a prediction of future performance.

8. Recommendations

Where defects are identified, the Inspector may recommend further investigation by an appropriately qualified specialist.

The Client acknowledges that additional investigations may identify defects not visible during the inspection.

9. Photographs

Photographs included in the Report are provided to illustrate observations only and should not be interpreted as showing every defect or every part of the property.

10. Client Responsibilities

The Client agrees to:

  • Provide accurate property details.
  • Ensure lawful access to the property.
  • Pay all inspection fees by the agreed due date.
  • Read the Report in its entirety.

11. Report Ownership

The Report remains the intellectual property of the Company.

Upon payment in full, the Client receives a non-exclusive licence to use the Report for the purpose of evaluating the purchase of the inspected property.

The Report must not be copied, altered, sold, published or distributed without the Company’s written consent.

12. Third-Party Reliance

The Report is prepared solely for the Client named in the Report.

No responsibility or liability is accepted to any third party who relies upon the Report without the Company’s prior written consent.

13. Limitation of Liability

To the maximum extent permitted by New Zealand law, the Company’s total liability arising from the inspection or the Report is limited to the amount paid by the Client for the inspection.

The Company is not liable for:

  • Hidden or concealed defects
  • Future deterioration
  • Defects that were not reasonably observable
  • Loss of opportunity
  • Consequential loss
  • Indirect loss
  • Economic loss arising from purchase decisions
  • Nothing in these Terms limits or excludes any rights that cannot legally be excluded under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

14. Time Limit for Claims

Any claim relating to the inspection or the Report must be notified to the Company in writing within 12 months of the inspection date, to the extent permitted by law.

15. Payment Terms

Payment is due on or before the issue of the Report unless otherwise agreed in writing.

The Company may withhold the Report until payment has been received.

Overdue accounts may incur reasonable debt recovery costs and interest where permitted by law.

16. Cancellation

The Client may cancel the inspection by providing reasonable notice.

The Company reserves the right to charge:

  • A cancellation fee of $99 if cancellation occurs within 48 hours of the scheduled inspection.
  • The full inspection fee if cancellation occurs within 24 hours of the scheduled inspection.

17. Force Majeure

The Company is not liable for delays or inability to complete the inspection due to circumstances beyond its reasonable control, including severe weather, natural disasters, access restrictions, or emergencies.

18. Privacy

Personal information collected from the Client will be used solely for providing inspection services, preparing the Report, invoicing and complying with legal obligations.

The Company will not disclose personal information except where required by law or authorised by the Client.

19. Governing Law

These Terms and Conditions are governed by the laws of New Zealand.

Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.

20. Acceptance

By booking or paying for the inspection, the Client acknowledges that they have read, understood and accepted these Terms and Conditions
